11.0: Service Retirement

Purpose

This section should be used when a member applies for service retirement. Both the member and employer should be certain that eligibility requirements have been met prior to submitting an application for retirement or terminating employment. Refer to Index 11.1 for a member who elects to take an Initial Lump-Sum Benefit. Refer to Index 11.2 for a member who is eligible and elects to participate in the Deferred Retirement Option Plan (DROP).

Note: A member must live at least 30 days after the effective date of retirement to be considered retired. If a member dies before that time, he or she will be considered to have died in active service, and only survivor benefits, not retirement benefits, will be paid. Refer to Index 13.0 for information about survivor benefits.

Action to be Taken

  1. The employer should make available to a member a retirement packet that consists of the following:
  2. The member must complete an Application for Service Retirement, ILSB, or DROP (Form 11). The application must be signed by the member and may be faxed to TRSL at 225-925-6366. Applications are accepted as early as six months prior to the effective date of retirement and must be received by TRSL on or before the member’s last day of employment to avoid possible loss of benefits. Do not hold the application awaiting copies of Social Security cards, birth certificates, etc. TRSL will request any missing documents.
     
  3. The member must furnish copies of the following (with Social Security number on each copy):
    • Social Security cards (as issued by the Social Security Administration) for the member, spouse, and all option beneficiaries.
       
    • Documents verifying the date of birth for the member and spouse. (Refer to Date-of-Birth Verification Requirements found on the reverse side of the Retirement Application Check List).
       
    • Documents verifying the date of birth for the beneficiary, unless Option 1 will be chosen.
       
    • Judgments of separation and/or judgments of divorce, including any community property settlements, if applicable.
       
    • Copy of spouse’s death certificate, if applicable.
       
  4. TRSL will mail an Affidavit of Retirement Option Election (Form 11E) to the member. The member must choose a retirement option on the affidavit. (See flowchart below.) If the member chooses a beneficiary other than a spouse or leaves the spouse less than 50 percent of the monthly survivor benefit, the spouse must complete the waiver on the reverse side of the Form 11E.

    As required by Louisiana law (LSA-R.S. 11:815), members retiring on or after January 1, 2002, must have benefit payments made by electronic funds transfer. The member must complete and submit a Direct Deposit of Benefits (Form 15D) before any benefit will be issued.
     
  5. All previous employers must certify all questionable years and sick leave used via the online update processes. A member’s most recent employer(s) should certify any and all questionable years and sick leave using the online processes at the time the member’s application is submitted. The Agency Certification (Form 11B) should be submitted by the most recent employer(s) after the member’s last day of employment.
Employer Checklist

Members must apply for retirement in writing by submitting an Application for Service Retirement, ILSB, or DROP (Form 11) no sooner than six months before the date of retirement. Termination of service does not automatically constitute application for retirement. Any member may cancel an application for retirement before the effective date of retirement or before cashing or depositing any retirement checks.

NOTE: The Application for Service Retirement, ILSB, or DROP (Form 11) can be submitted to TRSL prior to receiving the other documents listed below. TRSL will request any missing documents, if necessary.

  • Have member complete Sections 1, 2, 5, and 6 (Sections 3, 4, 6A, and 7, if applicable).
     
  • Attach copies of Social Security cards and birth certificates for applicant and all named beneficiaries.
     
  • Put member’s Social Security number on all copies. Birth certificates are not needed for beneficiaries, if Option 1 is chosen.
     
  • Attach certified copies of divorce papers and community property settlement papers, if applicable. Put member’s Social Security number on all copies.
     
  • Certify any questionable years and sick leave using the online update processes.
     
  • Attach a completed Direct Deposit of Benefits (Form 15D)
     
  • Counsel member about insurance deduction.
     
  • Keep a copy of all completed forms for the member’s personnel file.
     
  • Give a copy of all completed forms to the member.
     
  • Send TRSL all forms and required documents.
NOTE: Agency Certification (Form 11B) is not submitted until after the member’s termination date.

Additional form(s) to be completed and attached to Application for Service Retirement, ILSB, or DROP (Form 11), if applicable. IMPORTANT NOTE: Member must be retired 30 days before receiving any retirement benefits, including estimated benefit payments. Example: Member selects 01/08/2008 as retirement date. Benefit payments cannot begin until 30-day wait requirement is met. First benefit payment cannot be issued until 03/01/2008 (provided all needed documents are received).
